Vehicle and container release from seizure by the Moldavian Border Police

Recently, our Client – Ukrainian transport company engaged in sunflower oil transportation from Ukraine to Romania through Moldova – applied to Interlegal.

Under the Contract, our Client (as the Carrier) accepted container for transportation at the Kyiv warehouse and followed to the border between Ukraine and Moldova.

A crucial aspect was the following: the Carrier’s driver neither controlled the moment of stuffing container nor attended the sealing procedure but accepted for transportation a laden and sealed container.

While crossing the Moldavian border, customs control procedure resulted in fixing non-compliance between the cargo weight and nomenclature. Also, under the results of container and cargo inspection, it turned out that inside container there were antiseptics used for industrial purposes, instead of sunflower oil. Based on detected violations, the cargo was seized, while the Border Police detained truck and trailer with container.

The Client applied to Interlegal upon vehicle and container release.

Interlegal lawyers, featuring Moldavian office, analyzed both the documents and the situation in whole, developed legal position and found grounds for achieving the Client’s goal. Tight cooperation between Interlegal Ukrainian and Moldavian offices facilitated defense of the Client’s rights.
